CONDITIONS
1) Your statutory rights are in no way affected by these
Terms & Conditions.
2) We may change at the Terms & Conditions at anytime,
and in doing so, it is your responsibility to check what alterations have been
made. Your continued use of this Site, after any such changes, will constitute
your acceptance of the changes to these terms.
3) At our discretion we may change, terminate or suspend any
part of this website, including any content.
4) Acceptance of your order shall be acknowledged by e-mail,
and will confirm name, delivery address, value of goods to be shipped and
delivery
5) Prices stated on the website include standard rate VAT in
place at the time of sale.
PAYMENT
1) All monies are payable in Pounds Sterling (GBP).
2) Payment may be made by credit or debit card. You have the
option of using our secure online ordering system, or by telephone / fax
quoting your credit or debit card
number.
3) We do not accept cheques for Internet orders
4) No goods will be dispatched until funds have cleared. All
goods remain the property of Pinkbizz Limited until such time as the full
amount has been received.
5) If an instance occurs when we cannot fulfill your order,
we shall contact you with the offer of an alternative comparable product, or
the option to cancel the order in part or full, and at such time a refund shall
be given.
6) At no time will we store your credit or debit card
details electronically or otherwise.
7) Should you make errors in entering your order, you will
have a number of opportunities to correct it prior to finally confirming and
submitting the order for us to fulfill.
DELIVERY
1) Delivery times are governed by our carriers, and are
approximate.
2) Orders received by 11.30am Mon-Fri will be delivered by
Royal Mail First Class or Next Working Day Courier unless there are products
unavailable. Orders received after
11.30am will be delivered the following working day. No deliveries are made on Saturday or Sunday
except where sent by Royal Mail.
3) Any delivery times are quoted from when the order is
fulfilled to the package reaching its destination.
4) After seeking your approval we may dispatch your order in
multiple installments, as required.
5) If free delivery or any discount is offered, it will be
at our discretion and may not be available on certain products, or in certain
countries.
6) There is a minimum charge of delivery of £5 per order for
UK mainland deliveries for up to 5kg.
TAXES / DUTIES FOR OVERSEAS ORDERS
1) If local taxes or import duties are levied on your order
this shall be the responsibility of the buyer and not Pinkbizz Limited. We
therefore recommend that you check with your local authorities prior to placing
your order to avoid possible distress.
CANCELLATION POLICY
1) Under the Distance Selling Regulations you have the right
to cancel your order for up to 7 working days after the day you receive the
goods. You are entitled to a full
refund of the goods and delivery.
2) You must advise us within this period of your decision to
cancel the order either by written letter phone (to our shop telephone number)
or email to shop@denbighchocolateshop.com quoting your order no.
3) Please return the unwanted items to us within 30 days of
cancellation, in an unused condition and having taken reasonable care with it.
You will have to pay for the cost of returning the unwanted goods.
4) None of the above conditions apply to goods which are
personalised or have been made or ordered in to a special bespoke order (this
will be advised when the order is confirmed).
RETURNS POLICY - FAULTY, DAMAGED
OR UNSATISFACTORY PRODUCTS
1) If you are unhappy with an item when you receive it or if
any of the goods are faulty or damaged, please return the item to us within 30
days.
2) You must advise us within this period of your decision to
return the order either by written letter, phone (to the shop telephone number)
or email to shop@denbighchocolateshop.com quoting your order no.
3) We will refund you the full cost of your order including
delivery charges within 30 days of receiving notification that you will be
returning the product.
4) If you chose to return the package, you must obtain a returns
number via e-mail first, then return the box with the contents in the same
condition that they arrived. The cost of returning the package shall be the
responsibility of the buyer and not Pinkbizz Limited unless the goods are
faulty or are not what you ordered. In these circumstances we will pay you the
cost of the return postage.
5) We cannot accept returns for any product that was
specially ordered / bought in for your order unless they are faulty or damaged.
6) Please send all returned products to Denbigh Chocolate
Shop, 13 Vale Street, Denbigh, LL16 3AD.
LIMITATION OF LIABILITY & RISK
1) We cannot guarantee that our website will be available
100% of the time, and because of this any loss, financial or otherwise, will
not be our responsibility.
2) Loss or damage caused by our website or e-mail system,
through error or virus, shall not be our responsibility, and no compensation
shall be offered.
3) Any person, or persons, who do not agree to these terms
and conditions, should refrain from using our website and services immediately.
4) We have the right to refuse service, without prejudice or
reason.
5) The services we offer are only available to people over
the age of 18years, except by prior agreement.
6) We have the right to cancel any order up until the time
of shipping, and if this is so, we shall refund any and all monies paid in
respect to that order, and offer no compensation in return for any reason.
7) We shall abide by the laws and regulations of the UK
only, in any and all cases of legality.
COPYRIGHT & TRADEMARKS
1) www.denbighchocolateshop.com, its name, layout, design,
any code, text, graphics and logos shall remain the property of Pinkbizz
Limited and as such are protected by copyright and/or trademark.
2) All names and logos of products remain the property of
their respective owners.
3) Any reproduction of material, in part or full, from our
website is prohibited without prior consent.
GENERAL
1) Any amendments to this agreement shall be posted on our
website, and shall include the date on which it was last amended.
2) If any part of this agreement is found to be void or
unenforceable, it will be removed from the main body, and in doing so shall not
detract from the rest of this document, which will remain valid.
3) Until the order is collected by the carrier, and in part,
accepted by you, this shall be an enforceable document, and shall bind all
parties.
4) This contract shall be construed in accordance with
English Law and shall be subject to the English Courts exclusively.
5) If, within 5 working days of receiving your order, we
find that we cannot fill it, we shall contact you and offer you alternative
products or the option to withdraw the order either in full or in part.
6) The charge for delivery offered on our website, shall be
determined by the weight of the order or by a fixed price, its destination, and
the carrier appointed by us, this cost is agreed by you by your acceptance in
proceeding through the electronic checkout.
7) You acknowledge that for any goods that you order from
us, that you are over the legal age (if any) for the purchase of such items,
and that you can legally purchase these products in your country of residence.
